Privacy Policy

Soar BioDynamics, Ltd. (“Soar BioDynamics”) values your privacy and the privacy of our other customers and visitors to our Web sites, including SoarThroughLife.com (collectively, with any successor Web sites, the “Web sites”). Visitors to the Web sites are, collectively, referred to herein as “Users.”

This Privacy Notice describes what information Soar BioDynamics gathers from you via the Web sites (the “Information”), how we use that Information, and what we do to protect it. Your Information may include what we refer to as “Medical Information,” which is defined in more detail below but involves certain health-related information necessary for performing the Services (as defined below), “Personal Information,” which is a limited set of identifying information that allows for communication between Users and Soar BioDynamics and payment for the Services, and “Technical Information,” which includes certain information that is automatically collected from Users. Please note that we do not intend to gather personal data from individuals residing outside of the United States of America. By using the Web sites, you expressly consent to the Information handling practices described in this notice.

This Privacy Notice is incorporated into and is subject to the Soar BioDynamics Terms of Use. Your use of the Web sites and any Information you provide on the Web sites are subject to the terms of this Privacy Notice and Soar BioDynamics' Terms of Use.
 
1. Your Responsibility

It is your responsibility to limit the amount of Information, including Personal Information and Medical Information, you provide to Soar BioDynamics in order to ensure the level of privacy you want.
 
2. Your Choices

You may, of course, decline to share your Information with Soar BioDynamics, in which case Soar BioDynamics will not be able to provide to you some of the features and functionality, including the services such as Dynamic Screening, (collectively, the “Services”) found on the Web sites. You have two options to use the Services while limiting your risk of disclosure of Information that may be identified as yours: 1) you can ask your doctor or other health care professional to use the Soar BioDynamics Web site on your behalf without disclosing any of your personal Information, or 2) you can disclose an email address and a means of payment that cannot be linked to you.
 
3. Our Commitment to Data Security

Soar BioDynamics uses commercially reasonable physical, administrative, and technical safeguards to preserve the integrity and security of your Information. We cannot, however, ensure or warrant the security of any Information you transmit to Soar BioDynamics, and you do so at your own risk. Once we receive your transmission of Information, Soar BioDynamics makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such Information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. In an effort to protect your Information:

  • Soar BioDynamics works with some authorized service providers to provide website hosting and maintenance as well as other services for us. To the extent it is necessary for these service providers to complete their contractual obligations to Soar BioDynamics; these third parties may have access to or process your Information. Soar BioDynamics generally limits their use of your Information to the purpose for which it was shared.
  • Soar BioDynamics uses all of the Information that we collect to understand and analyze the usage trends and preferences of visitors to the Web sites, to improve the way the Websites works and looks, and to create new features and functionality.
  • If Soar BioDynamics learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Soar BioDynamics may post a notice on the Web sites if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a free written notice of a security breach you should notify us at support@soarbio.com.

 
4. Medical Information

You may provide to Soar BioDynamics certain Medical Information when using the Web sites. Your Medical Information may include:

  • Gender
  • Birth year
  • Test results and month

Soar BioDynamics may use your Medical Information (but not your Personal Information) in any of the following ways:

  • to provide the Services to you
  • to perform research to improve the functioning of the Services
  • to create a database of Dynamic Screening reports that may be referenced in developing and providing report to future Soar BioDynamics Users
  • to perform medical and health research of any kind.
  • for review, evaluation, and analysis by Soar BioDynamics and/or its agents
  • as part of a publication or presentation of the results of the Services in scientific journals or at medical meetings, provided that your Personal Information, i.e., your identity, will not be disclosed in any such publication or presentation
  • to develop, market and commercialize Dynamic Screening or other products.


5. Personal Information

Soar BioDynamics attempts to limit the Personal Information you provide to an email for communication with you and whatever information is needed by the payment method you choose. As mentioned above, you have two options for ways to use the Services while limiting your risk of disclosure of Information that may be identified as yours: 1) you can ask your doctor or other health care professional to use the Soar BioDynamics Web site on your behalf without disclosing any of your Personal Information, or 2) you can disclose an email address and a means of payment that cannot be linked to you.

In spite of our efforts to limit our collection of Personal Information, you may provide to Soar BioDynamics unsoliticited personally identifiable Information that is not necessary for performing the Services (such as your name, postal mailing address, ZIP code, telephone number, fax number, social security number, medical ID) when using the Web sites. Soar BioDynamics is not responsible for the security of this unneeded information but will use commercially reasonable efforts to handle it as Information in accordance with this Privacy Policy.

Soar BioDynamics uses the Information you provide or that we collect to operate, maintain, enhance, and provide all of the features, Information and services found on the Web sites. We will use your email address, without further consent, for administrative purposes, for customer service purposes, and to address intellectual property infringement, rights of privacy, or defamation issues.

Soar BioDynamics will not use your email address or other Personal Information to send promotional messages unless you have opted in or otherwise requested that Soar BioDynamics contact you about the Soar BioDynamics products and services or other information.

Soar BioDynamics does not sell, trade, rent or share your Personal Information with other organizations for their marketing or promotional uses without your express consent.

6. User ID and Password

You are responsible for maintaining the secrecy of your unique password and account Information at all times.

7. Technical Information Soar BioDynamics Collects

  • “Cookies” Information: When you visit the Websites, we may send one or more cookies – small text files containing a string of alphanumeric characters – to your computer. Soar BioDynamics may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Web sites. Persistent cookies can be removed. Please review your Web browser “Help” file to learn the proper way to modify your cookie settings.
  • “Automatically Collected” Information: When you visit the Web sites, we may automatically record certain Information from your web browser by using different types of technology, including “clear gifs,” Javascript or “web beacons.” This “automatically collected” Information may include Internet Protocol address (“IP Address”), Web browser type, the Web pages or sites that you visit just before or just after the Web sites, the pages you view on the Web sites, and the dates and times that you visit the Web sites.


Soar BioDynamics may use “automatically collected” Information and “cookies” Information to: (a) remember your Information so that you will not have to re-enter it during your visit or the next time you visit the Websites; (b) provide customized third-party advertisements, content, and Information; and (c) monitor aggregate site usage metrics such as total number of visitors and pages viewed.

Soar BioDynamics may disclose automatically collected and other aggregate non-personally-identifiable Information with interested third parties to assist such parties in understanding the usage, viewing, and demographic patterns for certain programs, content, services, advertisements, promotions, and/or functionality on the Web sites.

8. Disclosure for Legal and Liability Reasons

Soar BioDynamics may also disclose User Information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws or respond to a court order, judicial or other government subpoena, or warrant. In some cases, we may make such disclosures without first providing notice to Users.

Soar BioDynamics also reserves the right to disclose User Information that we believe, in good faith, is appropriate or necessary to take precautions against liability; protect Soar BioDynamics from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against any third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Web sites; or to protect the rights, property, or personal safety of Soar BioDynamics, our Users, or others.

9. Our Commitment to Children’s Privacy

Protecting the privacy of young children is especially important to Soar BioDynamics. For that reason, Soar BioDynamics does not knowingly collect or maintain personally identifiable Information on Web sites from persons under 13 years-of-age, and no part of Web sites is directed to persons under 13. If you are under 13 years of age, then please do not use or access the Web sites at any time or in any manner. If Soar BioDynamics learns that personally identifiable Information of persons less than 13-years-of-age has been collected on Soar BioDynamics without verifiable parental consent, then Soar BioDynamics will take the appropriate steps to delete this Information.

10. Storage of Information

Personally identifiable Information collected on the Web sites may be stored and processed in the United States or any other country in which Soar BioDynamics or its affiliates, subsidiaries or agents maintain facilities, and by using the Web sites you consent to any such transfer of Information outside of your country.

11. In the Event of Merger or Sale

In the event that Soar BioDynamics is acquired by or merged with a third-party entity, we reserve the right, in any of these circumstances, to transfer or assign the Information that we have collected from Users as part of such merger, acquisition, sale, or other change of control.

12. Changes and Updates to this Privacy Notice

This Privacy Notice may be revised periodically without further notice to you and this will be reflected by a “last modified” date below. Please revisit this page to stay aware of any changes. In general, we only use your personal Information in the manner described in the Privacy Notice in effect when we received that personal Information. Your continued use of the Web sites constitutes your agreement to this Privacy Notice and any future revisions.

For revisions to this Privacy Notice that may be materially less restrictive on our use or disclosure of personal Information you have provided to us, we will make reasonable efforts to notify you and obtain your consent before implementing such revisions with respect to such Information.
